It has now emerged that Sarah wairimu was too ashamed of her late husband Tob Cohen when he was still alive.
According to Tob Cohen’s family lawyer Shadrack Wambui, Sarah wairimu was misusing Cohen’s name in her numerous applications.
As a result, the lawyer urged the court that Sarah Wairimu should not be allowed to use Tob Cohen’s name because she never used it during their marriage.
“Our application is intended to have the cases that have been filed by this fictitious person named Sarah Cohen struck out because there is nobody who is known by those names,” he stated.
Wambui added that Sarah Wairimu was using Tob Cohen’s name with an intention of confusing the court in a bid to get a lenient ruling.
At the same time, justice Mugure Thande ordered that there should be no change of names in the properties belonging to deceased Tob Cohen until the two conflicting wills are addressed.
Initially, one Benard and Gabriel Cohen had been given a grant to control Cohen’s estate. However, the judge suspended the grant in the wake of an application by Sarah wairimu.
While Cohen’s lawyer Chege Kirundi claims to have the original copy of the Will, the wife Sarah wairimu equally claims that she has an original copy of the will, something which has made the whole case take a new twist.
According to Sarah Wairimu through her lawyer Philip Murgor, the will dated April 30th 2019 by the other party was forged with the aim of blocking her from inheriting the multi-million properties for her hubby Tob Cohen.
The estranged wife further accused Bernard of failure to present the original Will to the court as required under Rule 7(5) of the Probate and Administration Rules section 51(3) of the law of succession Act.
She maintained that the copy of the last Will of the deceased Bernard presented in court was not an authenticated one.
