The court has ruled that Babu Owino, will have to answer for shooting DJ Evolve at B-Club, Kilimani, in 2020.
The ruling comes after months of speculation and debate surrounding the incident, which left many questioning whether justice would be served since Babu Owino has some political influence.
Yesterday, Milimani Senior Principal Magistrate Bernard Ochoi made a ruling stating that the prosecution had provided enough evidence to require the MP to defend himself in court.
The magistrate expressed his satisfaction with the strength of the prosecution’s case against the accused and dismissed the MP’s assertion that the burden of proof had not been met. This is a significant development in the ongoing case.
The Embakasi MP stands accused of breaching the peace while wielding a firearm, having allegedly fired a single bullet with the intent of harming Mr. Felix Orinda, also known as DJ Evolve, at B-Club on January 17, 2020.
According to the prosecution, the MP contravened Sections 33 and 31 (1) of the Firearms Act, which stipulates a maximum sentence of one year imprisonment, a fine not exceeding Ksh 10,000, or both for those found guilty.
Babu Owino, who is currently out on bail, has a defense hearing scheduled to commence on June 15, 2023.
After reaching an out-of-court settlement with the DJ, the MP agreed to purchase an apartment in the name of DJ Evolve and his parents, as well as a custom-made car suitable for someone with a disability. As a result, the first charge of attempted murder was dropped.
As part of the agreement, the MP committed to covering the medical expenses and other costs incurred by the victim. By the time of his acquittal in December 2021, Mr. Owino had already paid a medical bill totaling Ksh 9.8 million to Nairobi Hospital. Additionally, he agreed to pay an additional Ksh 6.9 million in outstanding medical bills and expenses for nursing care.
