Controversial TikToker Brian Chira was on Monday arraigned in court to answer to defamation charges levelled against him by Azziad Nasenya.
Chira was arraigned at the Kibera Law Courts where he pleaded not guilty and was released on cash bail of 50,000 or a Kshs100,000 bond.
Speaking to digital creators, Azziad’s lawyer said the prosecution is not opposed to the court’s decision since bail is a constitutional right for accused persons
“Bail or bond is a constitutional right for every accused person. The court has the discretion to determine the same looking at the nature of the offence before it. It’s Chira’s right, we are not opposed to in anyway,” she said,
The lawyer added that they will withdraw the case from the court if Chira aopoloigizes to Azziad.
“The issue is between Chira and Azziad. In the event that anytime from now Chira is willing to issue an apology then Azziad is at liberty to accept it. In the event that she accepts it we go to the next stage where they will come to court, inform the court of what they have agreed as individuals and the court can not be opposed to it, if they have agreed and the complainant is willing to withdraw the case the court can not move if you are not willing to prosecute the same,” she said.
Chira was arrested last Thursday and was held in custody at a police station near Wilson Airport.
